Regulatory settlement sets cleanup duties after Gateway Energy Storage fire in San Diego

In May 2024 a thermal event occurred at the Gateway Energy Storage Camino facility, a grid scale lithium ion battery storage site in San Diego, California, United States, involving nearly 15,000 nickel manganese cobalt lithium ion batteries housed in a single building. The fire started in mid May and periodic flare ups continued for around two weeks. No injuries were reported. This entry complements an earlier case study on the same event and covers the regulatory aftermath rather than the technical cause. The US Environmental Protection Agency subsequently entered into a settlement agreement with LS Power, the owner of Gateway Energy Storage, requiring the cleanup of the site to be carried out and paid for. Under the agreement the operator is to conduct environmental monitoring during all battery handling operations, remove, package and dispose of the affected battery packs, submit detailed work plans to the regulator, and provide regular progress reports. As reported, the settlement does not impose monetary penalties but establishes binding cleanup obligations. The regulator continued to oversee the cleanup in coordination with local fire authorities and county government, and officials publicly noted broader concerns about grid scale battery fires and their effect on first responders.

Public reporting indicates that the cause of the original fire remained under investigation at the time the settlement was announced. Sources noted that the extended period of flare ups is consistent with the recognised difficulty of fully suppressing thermal runaway in dense lithium ion installations.

  1. Plan for post incident regulatory and cleanup obligations that can continue for months after the fire is extinguished, and allocate staff and resources to them in the emergency plan.
  2. Include environmental regulators, alongside the fire service, in incident notification lists and emergency response arrangements from the outset.
  3. Treat handling of fire damaged cells as specialist work, with environmental monitoring, packaging and disposal protocols identified and contracted before an incident occurs.
  4. Maintain site security, monitoring and access control throughout the cleanup phase, because damaged cells can retain fire, explosion and chemical release risks for an extended period.
  5. Include cleanup, environmental monitoring and regulatory compliance costs in insurance cover and project contingency budgets, not only asset replacement costs.
  6. Hold template work plans and progress reporting formats that can be prepared and submitted to a regulator at short notice, so that remedial work is not delayed by documentation.
